1. About CheckMyCars

CheckMyCars operates as an online platform that facilitates connections between customers seeking vehicle inspection services and available Car Agents / Vehicle Inspectors at different locations.

CheckMyCars primarily acts as a platform and intermediary for facilitating bookings, communication, service coordination and delivery of inspection-related information.

CheckMyCars does not itself employ every Car Agent / Vehicle Inspector available through the platform.

2. Independent Car Agents / Vehicle Inspectors

Car Agents / Vehicle Inspectors available through the CheckMyCars platform at different locations are independent individuals / service providers and are not employees of CheckMyCars, unless expressly stated otherwise in writing.

Their availability, experience, knowledge, skills and method of conducting an inspection may vary depending upon the individual and location.

The customer acknowledges that the inspection may be physically performed by an independent Car Agent / Vehicle Inspector facilitated through the CheckMyCars platform.

3. Role of CheckMyCars as a Platform / Intermediary

CheckMyCars acts primarily as a facilitating platform / intermediary connecting customers with available Car Agents / Vehicle Inspectors.

CheckMyCars may facilitate:

• Customer booking
• Appointment coordination
• Communication
• Location coordination
• Inspection assignment
• Collection and processing of booking information
• Generation, compilation or delivery of inspection reports
• Customer support relating to the platform and booking.

The physical inspection and the professional observations made during the inspection may be performed by the respective independent Car Agent / Vehicle Inspector.

4. Agent's Knowledge, Experience and Feedback

Any feedback, comments, observations, opinions, assessments or recommendations provided by a Car Agent / Vehicle Inspector are based on that individual's knowledge, experience, professional understanding and observations at the time of inspection.

The opinion or feedback of an individual Car Agent / Vehicle Inspector:

• Is their own professional observation;
• Does not automatically represent the opinion of CheckMyCars;
• Is not necessarily reviewed, verified or independently endorsed by CheckMyCars;
• May differ from the opinion of another inspector or technical professional.

CheckMyCars does not represent or warrant that it agrees with, endorses or guarantees every opinion, assessment, recommendation or conclusion provided by an individual Car Agent / Vehicle Inspector.

5. No Employer–Employee Relationship

Nothing contained in these Terms & Conditions shall be interpreted as creating an employer–employee relationship between CheckMyCars and any independent Car Agent / Vehicle Inspector, unless expressly agreed in a separate written agreement.

The Car Agent / Vehicle Inspector is responsible for providing the inspection service in accordance with the agreed inspection scope and applicable laws and safety requirements.

6. Inspection Scope

The inspection is a visual, physical and functional assessment based on the selected inspection package.

CheckMyCars / the assigned Car Agent inspects what is accessible and reasonably detectable at the time and location of inspection, records observations and findings, and states relevant limitations.

The inspection is not a warranty, guarantee, certification, fitness certificate or assurance that the vehicle is free from defects.

7. Inspection Limitations

The inspection does not guarantee detection of:

• Hidden or latent defects
• Internal mechanical defects that cannot reasonably be observed
• Intermittent faults not present during inspection
• Defects requiring dismantling or opening of components
• Future failures or deterioration
• Defects concealed, repaired or altered before inspection
• Defects that cannot reasonably be detected under the inspection conditions.

No component will be dismantled or opened unless specifically included in the selected service and technically and safely permissible.

8. Inspection Report

The Inspection Report records observations made during the inspection.

The report represents the condition of the vehicle as observed at the date, time and location of inspection.

Photographs, measurements, diagnostic information and observations may be included where applicable.

The report should not be interpreted as confirmation that the vehicle is completely free from defects.

9. New Car PDI

New Car PDI is intended to identify observable discrepancies, cosmetic issues, transportation-related damage and accessible functional abnormalities before delivery.

CheckMyCars does not determine whether a customer should accept or reject a vehicle.

The final decision regarding purchase, delivery, registration and insurance remains solely with the customer.

10. Used Car Inspection

Used Car Inspection provides observations regarding the accessible and reasonably detectable condition of the vehicle at the time of inspection.

Unless specifically included in the selected package, the inspection does not guarantee:

• Accident history
• Ownership history
• Service history
• Odometer authenticity
• Insurance history
• Legal status
• Registration history
• Future reliability or performance.

11. EV Inspection

EV inspection is limited to the checks specifically included in the selected EV inspection package.

Unless expressly stated otherwise, CheckMyCars does not provide or guarantee:

• Battery cell health certification
• Battery degradation certification
• BMS diagnostic certification
• Future battery performance
• Future driving range
• Battery life prediction.

12. Commercial Vehicle Inspection

Commercial vehicle inspection is limited to the checks included in the selected inspection package.

Specialised, regulatory, load-bearing or operational checks are excluded unless expressly included in the selected package.

13. Customer Responsibility

The customer is responsible for:

• Providing accurate information;
• Providing correct vehicle details;
• Ensuring the vehicle is available for inspection;
• Providing necessary access and permissions;
• Reviewing the Inspection Report; and
• Making the final vehicle-related decision.

14. Dealer / Seller / Owner Permission

CheckMyCars and/or the assigned Car Agent does not guarantee that a dealer, seller, owner, showroom, workshop or other premises operator will permit every inspection activity.

If any inspection activity cannot be performed because of lack of access, permission, safety conditions or other circumstances, the relevant limitation may be recorded in the report.

16. Third-Party Information

Where information is obtained from dealers, sellers, manufacturers, service centres, insurance providers, registration authorities or other third parties, such information may be recorded based on its availability.

CheckMyCars does not independently guarantee the accuracy of information supplied by third parties.

17. No Guarantee of Future Condition

The Inspection Report reflects observations made at the time of inspection.

Vehicle condition may change after inspection because of use, accident, repair, tampering, environmental conditions, wear and tear or other circumstances.

CheckMyCars does not guarantee future vehicle condition, reliability, performance or resale value.

18. Liability

To the maximum extent permitted by applicable law, CheckMyCars shall not be liable for indirect, incidental, consequential or future losses arising from the purchase, ownership, use, resale, repair or subsequent condition of a vehicle based solely on reliance upon an inspection report.

Where liability is legally established against CheckMyCars in relation to its platform or facilitation service, the maximum aggregate liability of CheckMyCars shall, subject to applicable law, be limited to the inspection service fee actually paid by the customer for the relevant booking.

Nothing in these Terms shall exclude or limit any liability that cannot legally be excluded or limited under applicable law.

19. Report Review / Discrepancy

If the customer believes that an important observation relating to the inspection has been incorrectly recorded or omitted, the customer should contact CheckMyCars within 24 hours of receiving the report.

Any review will be limited to the original inspection scope and the information available at the time of inspection.

20. Service Availability

Inspection appointments are subject to Car Agent availability, vehicle availability, location, access permissions, safety conditions, weather and other operational circumstances.

CheckMyCars may reschedule an inspection where circumstances reasonably prevent the inspection from being completed.

21. Cancellation and Refund

Cancellation, rescheduling and refund requests shall be governed by the CheckMyCars Refund & Cancellation Policy applicable to the booking.

Where an inspection has already been substantially performed, refund eligibility may be affected.

22. Intellectual Property

CheckMyCars reports, inspection formats, checklists, website content, graphics, logos, templates, software and other proprietary materials are owned by or licensed to CheckMyCars unless otherwise stated.

Unauthorised copying, reproduction, distribution, commercial use or modification is prohibited.

23. Vehicle Manufacturer / Brand Disclaimer

Vehicle manufacturers, brands, logos and trademarks mentioned in connection with vehicle identification belong to their respective owners.

CheckMyCars is an independent vehicle inspection platform and is not affiliated with, endorsed by or authorised by any vehicle manufacturer unless expressly stated.

24. Privacy

Customer information shall be handled in accordance with the CheckMyCars Privacy Policy.

Information may be used for booking, inspection coordination, report preparation, customer support and legally permitted business communication.

25. Changes to Terms

CheckMyCars may update these Terms & Conditions from time to time.

The latest version published on the CheckMyCars website shall apply to future bookings unless otherwise required by applicable law.

26. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the applicable laws of India.

Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts at Chhatrapati Sambhajinagar (Aurangabad), Maharashtra.

27. Acceptance

By submitting a booking request, making payment, scheduling an inspection or using any CheckMyCars service, the customer confirms that they have read, understood and accepted these Terms & Conditions.
